2. The Search for General Tso

If you’ve ordered takeout from a Chinese restaurant in the US, you most likely have seen General Tso’s chicken as a menu item. Yet, the dish, although named after a real Chinese general, did not originate in China. It was invented in Taiwan after many Chinese chefs fled mainland China after the Chinese civil war and, many decades later, became popular in the United States after the media began reporting that then-Secretary of State Henry Kissinger liked it.

Peng Chang-Kuei, a Taiwanese chef who is sometimes credited with being the creator of General Tso's chicken, adapted the original Hunanese flavors of the dish to his American clientele by adding ingredients like sugar to his original recipe when he opened his first restaurant in New York City in the 1970s. That way, General Tso’s chicken became the sweet dish we know today. 

The Search for General Tso is an excellent example of how immigrants in the food business adapt to the tastes of their new communities. Ian Cheney, the film’s director, was puzzled about the prevailing nature of General Tso’s chicken in Chinese restaurants in the United States, especially when compared to its complete absence from menus in China and the fact that many Chinese could not recognize the dish in pictures. Cheney uses the example of General Tso’s chicken to explain the history of Chinese immigration to the United States, including the legislation passed over time to specifically prevent Chinese nationals from immigrating to the United States during 

times of heightened racism.

In the face of prejudice, Chinese immigrants in the United States went deeper into America’s heartland and started gaining the trust of people that may have previously held prejudices against them by making delicious, comforting food: “Chinese food without the weird stuff.” Through a mix of comedy and thorough research, Cheney showcases how Chinese immigrants have used food to assimilate but created a distinct style of food that Americans have embraced as time passes. 

3. The Migrant Kitchen

The Migrant Kitchen is a five-part documentary series, later becoming a TV show, exploring the intersections between food and immigration in America, as well as how chefs and other food industry workers, who are from immigrant backgrounds or immigrants themselves, are changing perceptions of food by fusing different cuisines and cooking styles to come with entirely new cuisines. Given that workers in the food industry include immigrants coming to the United States through multiple immigration processes, and food is a unifying force across all communities, this is an excellent docu-series for any immigration lawyer to watch.

In immigration law, referrals are welcome and, at times, the ideal strategy. More generally, referrals help grow your client base and, by extension, your professional network, while providing clients with a more compelling experience by putting their case in the hands of perhaps a more qualified lawyer given their needs.

That being said, referrals come with rules that, whether you are referring to another immigration lawyer or receiving a referral from one, you need to be aware of and follow carefully. And rules about referrals can sometimes be confusing, especially if you’re a new attorney and haven’t done many referrals, or any at all.

This article dives into referrals for attorneys and non-attorneys.

General rules for attorney referrals 

There are two sets of rules that govern referrals for immigration lawyers: the state bar rules and federal rules. For purposes of this article, we’re going to examine federal rules, since state rules tend to vary (and you should check your state’s rules and regulations around referrals).

At the federal level, rules about referrals are often modeled after the American Bar Association’s own model rules, specifically 1.5 (e), 5.4 (a), and 7.2 (b). 

Model Rule 1.5: Fees

Model Rule 1.5 refers to fees and outlines explicitly under what circumstances lawyers in different firms can split a payment. In short, how a fee is divided between lawyers in other firms when working on referrals has to be proportional to the work each lawyer does - which means that, at times, an even 50-50 split may not be appropriate. The client has to agree on how fees will be split and has to confirm that agreement in writing, and the payment itself must be “reasonable.” which means that, for example, you cannot raise a rate on a client just because you’re referring them to another lawyer.

So, if you’re going to work with another attorney on a case, explain to your client why this is needed and how the other lawyer will possibly help their case outcome to ensure they understand what they’re agreeing to when they sign off on the referral. 

Model Rule 5.4: Professional Independence of a Lawyer

Model Rule 5.4 refers to the professional independence of a lawyer. Section A of this rule refers to how lawyers should share fees with nonlawyers. The bottom line is that lawyers cannot share fees with nonlawyers unless payments are disbursed to a lawyer’s estate, a nonprofit organization that the lawyer worked with or recommended, or a firm’s retirement plan. So when it comes to payments to nonlawyers, there are rules set up to allow for indirect payments in some circumstances, but not many, which limits the possibilities for referring to nonlawyers with proper compensation. 

Model Rule 7.2: Communications Concerning a Lawyer's Services: Specific Rules

Model Rule 7.2 regulates communication about a lawyer’s services and to what extent they can pay others to recommend them, with section (b) explaining how lawyers can pay others for telling others about the lawyer’s services. Rule 7.2 explains that lawyers cannot make promises outside of the scope of their profession, and that lawyers may thank referrals with tokens of appreciation proportional to the work performed and what would be reasonable as a gift in professional relationships. Gifts should not be equivalent to compensation for services. 

Applicable rules regarding paying for referrals depend on the nature of the professional practice of the referral: lawyers and non-lawyers. Let’s review the rules for paying for referrals to lawyers first. 

Rules for paying referral fees to lawyers

The first thing to consider when referring to other lawyers, and paying fees, is that, as an immigration lawyer, you can only refer to other competent lawyers. It is your responsibility to ensure that if you bring another immigration lawyer on board for a case, that lawyer has the knowledge and expertise to help you and your client effectively. In addition, given that you need your client’s consent in writing to proceed with the referral, you must assure them their case is in better hands by referring them to another lawyer for part or all of the case. 

In summary, rules for referring cases to lawyers include: 

  • How you and the other lawyer divide fees has to be “proportional.” Many lawyers find this rule challenging to interpret, as “proportional” doesn’t necessarily mean “equal.” What this means is that you don’t necessarily have to split fees 50-50; if the work performed doesn’t represent half of what you would charge in that case typically, then it’s not proportionate, and you and the referred lawyer can agree on what proportional means in your referral agreement.

  • Your client has to agree to the referral in writing, not just to the referral itself, but also to the work the referred lawyer will complete and how much of the client fee they will receive.

  • The total fee you charge has to be reasonable. 

When you refer work to another lawyer, remember that you’re liable for malpractice claims. Given this, it’s also important to outline in your referral agreement what responsibilities, in addition to working on the case, the referred lawyer will have concerning the case. For example, if you’d like the referred lawyer to provide periodic updates to the client on the part of the case they’re working on, make sure your client knows those updates will come from the referred lawyer. 

Next, let’s examine the rules for paying non-lawyers referral fees. 

Rules for paying referral fees to nonlawyers

The rules regarding nonlawyers are a bit more straightforward. Basically, you cannot pay referral fees to non-lawyers. It’s also important to remember that lawyers licensed out of the state are considered “nonlawyers” in some states, such as Florida. So if you’re thinking about referring to a lawyer out of your state, you may have to treat them as nonlawyers in your referral agreement, depending on your state bar’s rules. 

However, there are other ways to show appreciation for a nonlawyer you refer a case to or otherwise get help from. Here are some ideas of how to thank nonlawyers for their work on a case: 

  • Handwritten cards or letters. Always keep a set of stamps and blank thank you cards in hand to write these notes by hand and put them in the mail or, with email and digital messaging being a more prevalent form of communication, send a virtual thank you.

  • Gifts. Rule 7.2 on the ABA Model Rules of Professional Conduct says you can give reasonably priced gifts. A new car, for example, is probably not such a gift, and if you’re looking for gift ideas and run into an item that makes you wonder if the recipient may see it as unreasonable, that could be a good measure of something not being reasonable.

  • Special events. You could put together a game or movie night, hire a food truck and invite your referrals for lunch, dinner, a treat, or a gathering of your professional network. This could provide an excellent opportunity for all the professionals in your network, lawyers and nonlawyers alike, to interact with each other and celebrate the great work you have all done through different referrals.

  • Public expressions of appreciation. Whether you highlight your referrals in your social media, your newsletter, or your website, people appreciate public recognition. It brings more visibility to their business and builds trust between you and them. And naturally, when potential clients see that you know other professionals who can support your work, that enhances their trust in you as well. 

Whether referring to lawyers or nonlawyers, always clearly communicate with the professional you’re referring work to, and the underlying client, to ensure the results of the referred work is known. Indeed, referrals are an ongoing strategy to strengthen your professional network and ensure you continue building a track record of success in your immigration law practice, whether you complete cases independently or with support.

With over 1700 members, “Crimmigration” is a more niche Facebook group focusing on immigration law involving a criminal issue. Crimmigration members work with clients dealing with charges and convictions at different levels that have or may have immigration implications. Group admins also routinely share legal opinions concerning immigration law that have a criminal law component, sometimes even with short summaries, so you can get an idea of the precedent.

When your clients have a criminal history, you may have to think outside the box - running those options by the Crimmigration Facebook group community and gaining some additional insight through other lawyers’ feedback can help you take your client in a more positive direction. Of course any substantive recommendations, whether from Facebook or elsewhere, should always be double-checked, but if this is your area of focus, consider joining the Crimmigration Facebook group.

Artificial intelligence (AI), specifically generative AI, continues to be a topic of conversation and debate amongst legal professionals. The advantages that generative AI platforms such as ChatGPT bring to lawyers, such as saving time on administrative tasks, doing quick research, and more, have made AI very popular among immigration lawyers.

But the rise of AI in the legal profession has brought with it concerns, specifically around privacy. Until recently, ChatGPT had no option for users to opt out of sharing data with the AI, including using said data to continue training the model, and the way this data is used poses concerns for lawyers about how safe client information is inside generative AI platforms, whether they are breaking ethics rules regarding confidentiality, etc.

In this article, we look into the importance of data privacy in AI and why it’s crucial, some AI platforms making a greater effort to safeguard user data, and some features of generally secure AI platforms you should be aware of.

The importance of protecting data within AI 

What makes AI models such as ChatGPT so impressive is their ability to learn with each query. Every time you put a question into a generative AI platform or enter some information, the platform, in a sense, expands its knowledge base. However, as a lawyer, you are responsible for keeping your client’s data safe.

Most websites and online platforms have privacy policies you must agree to use. These documents are usually long and full of legalese not often fully understood to the general public, which raises the concern of whether web users genuinely understand the consent they’re giving regarding their data. 

One of the most significant advances in legislation for online privacy comes from the European Union (EU) in the form of the General Data Protection Regulation (GDPR). Not only does this law require websites operating in the EU to provide more detailed opt-in and opt-out data sharing options it requires decisions that are made automatically based on personal information that could affect someone’s employment status, credit, or insurance; users' ages, and users have the right for the decision to be reviewed by a person

However, legislation regarding data privacy online is not universal, and only some of the same protections exist for online platforms across the globe. Possible discrimination some users may face due to the data access companies have is one of lawmakers' most pressing concerns in ensuring data privacy laws genuinely protect users. It’s also difficult to predict how much machine learning will advance and what AI will do, making it difficult to legislate for future situations preemptively.

Data privacy updates on AI tools used by Immigration Lawyers

As concerns over the privacy and use of data captured through AI tools have grown, developers have taken increasing protections, accountability, and user options into their own hands. Some are more exhaustive than others, but all are worth mentioning:

ChatGPT’s new opt-out features

The explosive popularity of chatGPT brought with it many privacy concerns surrounding AI to the surface. In response to that, ChatGPT has, to its developer OpenAI’s credit, made changes.

Specifically, ChatGPT now allows users to disable sharing their chat history, which means users control which conversations are shared with OpenAI to continue training the AI model. With this new update, even when you turn on chat history, conversations are only kept on servers for 30 days, then they are deleted forever from OpenAI. Before the “turn off chat” feature was available, users had to fill out a form to opt out of saving their chat history, which wasn’t very easy to find (it was on a blog post where OpenAI explained their privacy policy). Now, the “turn-off chat history” button, which appears in every conversation now, is a much more transparent and accessible option for data privacy. 

It’s important to point out that pressing factors pushed the change: Not only were there raising concerns about how ChatGPT handled data and how private it kept it, but the platform had a recent data breach. Privacy and data handling concerns prompted some countries in the European Union to restrict the use of ChatGPT. Moreover, the Federal Trade Commission had received complaints asking for a pause in developing AI technologies altogether due to safety concerns. 

In addition to its “basic” model changes, OpenAI has also announced a ChatGPT Business version. The expectation is that this subscription-based service will have even tighter controls over how users allow OpenAI to utilize conversational data.

Fireflies.ai’s focus on secure note-taking

Most of the conversation surrounding data privacy concerns covers word processing data, so there is a bit more gray area regarding data captured by voice and video, which is the data that a platform like Fireflies.ai, an AI-powered recording, transcription and note-taking app, takes in. Fireflies prioritizes data privacy by providing end-to-end encryption, not just for transcripts, but all data that goes through their platform, including metadata such as calendars, emails, and user settings. That data only exists on the Fireflies servers for one year, and after that, you cannot recover it. Fireflies stores data in industry-trusted servers Amazon Web Services (AWS), which holds data for some of the largest companies in the world. 

Fireflies gives the user control of the recording process from the beginning by giving users the choice of who gets access to each record. Fireflies offers several options for every meeting so you can control the access participants and people outside of your organization may have to a transcript and how they may or may not share its contents with others. OpenAI cannot use data from meetings Fireflies transcribes to train the AI; Fireflies routinely conduct third-party audits of their security processes to ensure confidentiality is protected. 

CoCounsel: AI created with lawyers’ ethics in mind

The need for stronger privacy protections within AI platforms used in the legal space has become even more accentuated with the increase in law firm cyberattacks in the past three years: over 750,000 Americans had their personal information compromised due to cyberattacks on law firms. Since lawyers are bound to rules of professional conduct that include ensuring the confidentiality of their client’s information, lawyers must use online platforms that meet the highest security standards.
